1. The App

CalorieKit is a calorie and nutrition tracking application for iOS. The App helps you log food, track calories and nutrition goals, and review your progress over time.

All of the data you enter into the App — such as food logs, weight, goals, and other personal information — is stored locally on your device. We do not operate a backend server that collects or stores your personal tracking data, and we do not track your activity within the App.

2. Health Disclaimer

CalorieKit is intended for general informational and self-tracking purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

Calorie and nutrition estimates provided by the App are approximations and may not be fully accurate. Always consult a qualified healthcare professional before making decisions about your diet, weight, or health, especially if you have a medical condition, are pregnant, or have a history of disordered eating.

You use the App's health and nutrition features at your own risk.

3. Subscriptions and Purchases

CalorieKit is offered on a freemium basis. Core features are available for free, and additional features may be unlocked through an auto-renewing subscription ("Subscription").

Subscriptions are purchased through the Apple App Store and processed using RevenueCat, our subscription management provider. Payment will be charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew for the same duration and price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage or cancel your subscription at any time in your device's App Store account settings. Cancelling does not retroactively refund amounts already charged. Refunds are handled by Apple in accordance with its own policies, as we do not have access to or control over App Store payments.

Prices, features included with a subscription, and free-trial availability may change from time to time; any such changes will not affect a subscription period you have already paid for.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by applicable law, and not to use the App in any way that could damage, disable, or impair its functioning.

5. Intellectual Property

The App, including its design, features, graphics, and underlying software, is owned by Tim Pelser and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license to use the App for its intended purpose, no rights are granted to you in the App or its content.

6. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Tim Pelser shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App. In no event will our total liability to you exceed the amount you have paid us, if any, in the twelve (12) months preceding the claim.

8. Termination

We may suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms. You may stop using the App at any time by deleting it from your device.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the App after any changes take effect constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of France, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of France, subject to any mandatory consumer-protection rights you may have under the laws of your country of residence.
